What is Foreclosure?

Foreclosure is a legal process by which a creditor satisfies the amounts it is owed from a debtor from the debtor’s assets.  Typically, a creditor seeks to foreclosure on the debtor’s real property. For instance, any non-exempt personal residence or other real estate owned by the debtor can be foreclosured upon.

Types of Foreclosure in Colorado

In Colorado, there are two general types of foreclosures. The first is judicial foreclosure. The second is foreclosure of a deed of trust by the Office of the Public Trustee (“nonjudicial foreclosure”). While judicial foreclosure occurs through the court system, nonjudicial foreclosure occurs through the Office of the Public Trustee. The differences between these two types of foreclosures are drastic and depend on what type of interest a creditor has.
